General Terms and Conditions
1. General Provisions
1.1 These General Terms and Conditions apply to all contracts concluded between Saida Nails GmbH, represented by Saida Nasirova, Siedlungsweg 5, 94315 Straubing, Germany, (hereinafter referred to as “Saida Nails”) and customers who shop via the online store www.saida-nails.de. Customers can be businesses and consumers. The version of these General Terms and Conditions valid at the time of the order always applies.
1.2 A consumer in this sense is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or independent professional activity (§13 BGB). An entrepreneur in this sense is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§14 BGB).
1.3 Any deviating terms and conditions of the customers are hereby rejected. Saida Nails only recognizes deviating terms and conditions if this has been expressly agreed upon in writing.
2. Order Confirmation and Conclusion of Contract
2.1 Customers have the option to purchase goods (hereinafter referred to as “goods”) via the website www.saida-nails.de.
2.2 The display of goods in the online shop does not constitute a legally binding offer by Saida Nails, but rather a non-binding online catalog and thus an invitation to the customer to submit a corresponding offer. By clicking the “buy” button, the customer submits a legally binding offer for the goods contained in the shopping cart. Saida Nails will then confirm receipt of the order by an automated email. The order for the goods will be confirmed by a separate email after Saida Nails has reviewed the order. This email confirmation is considered a legally binding acceptance, and the purchase contract is thus concluded.
2.3 All goods contained in the online shop and their prices are offered as described with the displayed goods.
3. Access to Contract Text
Saida Nails stores the contract text after the conclusion of the contract. Customers can view the General Terms and Conditions on the website and their order data in their customer account.
4. Prices, Payment, Delivery, and Customs
4.1 The contract is concluded at the prices valid at the time of order, as stated on the website www.saida-nails.de. The prices consist of the purchase price including all taxes and other price components, and any applicable shipping and delivery costs (hereinafter referred to as “total price”). The prices include the applicable statutory value-added tax.
4.2 The delivery of goods is at the customer’s expense. The shipping and delivery costs are listed separately on the website and are specifically indicated during the ordering process. The corresponding information on shipping and delivery costs can be found under the section “Shipping and Delivery Costs,” which is available on the website www.saida-nails.de with the corresponding subpages of the website at any time via the “Shipping and Delivery Costs” button in printable form.
4.3 The goods will be shipped after the contract has been concluded and the total price has been received in Saida Nails’ account. Shipping can also take place on a specific, later date, provided the parties have agreed upon this. The customer will be informed in due time about any delivery delays. If items with different delivery times have been ordered, they will be shipped in a single delivery, unless a different agreement has been made with the customer. In this case, the delivery time for the entire shipment will be determined by the item with the longest delivery time.
4.4 For deliveries to countries outside the EU, customs duties are incurred in addition to shipping costs, which we unfortunately cannot estimate in advance. They are determined by the respective regulations of the destination country. Customs clearance is handled by the shipping company (e.g., UPS).
- Option 1: As a customer, you will be contacted by the freight forwarder by phone upon arrival of your delivery in the destination country. They will inform you of the tax amount you still need to pay.
- Option 2: In some cases (or if you could not be reached by phone), the delivery person will request the amount in cash at your doorstep.
5. Payment Due
Payment of the purchase price in the amount stated on the invoice is due immediately and without deduction. The customer has the following payment options: advance bank transfer, PayPal, Stripe, credit card, Apple Pay or cash payment upon collection.
6. Right of Withdrawal
Consumers, i.e., natural persons who conclude a legal transaction for a purpose that cannot be attributed to either their commercial or independent professional activity, have a right to cancel in the case of a distance contract, i.e., a contract concluded exclusively using remote communication means (e.g., email, internet, telephone, fax, letter) without the simultaneous physical presence of the contracting parties.
Cancellation Policy for Consumers

You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You can use the attached sample cancellation form for this purpose, but it is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising the right to cancel before the cancellation period has expired.
Consequences of Cancellation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days of the day on which we receive notification of your withdrawal from this contract. For this refund, we will use the same payment method you used for the original transaction, unless something different has been expressly agreed with you. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
If a voucher was used in the payment of the returned order, it will first be deducted and credited as a new balance for future purchases. Should the sum of the returned goods exceed the corresponding voucher value, the difference will be paid out.
You must return the goods without undue delay and in any event not later than 14 days from the day on which you inform us of the cancellation of this contract, to

The deadline is met if you send back the goods before the period of 14 days has expired. You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is attributable to handling that is not necessary for testing the condition, properties, and functionality of the goods.

7. Agreement on Bearing Costs
If a consumer exercises their right to cancel, they shall bear the regular costs of returning the goods.
8. Rights for Defects
8.1 The purchased item is defective if it shows defects. Differences between the images on the website and the actual goods, which are due to the quality (e.g. resolution) of the photos on the website, or color differences due to different monitor types/color settings, do not constitute a defect.
8.2 Customers who are entrepreneurs can only assert obvious defects in the delivered goods if they notify Saida Nails GmbH, represented by Saida Nasirova, Siedlungsweg 5, 94315 Straubing, Germany, E-Mail: info@saida-nails.de, in writing or by email immediately after delivery with a precise description. The dispatch of the notice of defect is decisive. Later assertion is excluded. If only merchants are involved in the contract, §§ 377 et seq. of the German Commercial Code (HGB) apply additionally.
8.3 If defects exist and have been asserted in due time, Saida Nails is entitled to supplementary performance. Otherwise, the statutory provisions apply with regard to warranty.
8.4 The statutory warranty applies to consumers.
9. Returns and Refunds
9.1 If there are clear defects in the goods shipped by Saida Nails GmbH, the buyer must file a complaint and return the goods to Saida Nails GmbH, Siedlungsweg 5, 94315 Straubing (see Section 8 – Rights for Defects). In this case, the costs for the defective goods will be immediately reimbursed to the customer.
9.2 If the goods are returned for other reasons, e.g. dislike, this reason must be reported immediately after receipt of delivery – in writing by email to info@saida-nails.de or by post to Saida Nails GmbH, represented by Saida Nasirova, Siedlungsweg 5, 94315 Straubing, Germany. The dispatch date of the declaration is decisive. Subsequently, the goods must be returned to the same postal address. The customer bears the costs for such a return that is not based on product defects.
9.3 Saida Nails GmbH reserves the right not to refund money for goods if they are not returned by the customer in their original condition and/or were not complained about in advance. Goods from canceled orders must reach us in their original condition to be eligible for a refund. This means that the returned goods must reach Saida Nails GmbH unopened in their original packaging. If the goods have already been opened and/or partially used, any claim for reimbursement of costs will be forfeited. An exception to this rule only applies to clear quality defects of the product that can only be detected during use, i.e. after opening the goods (see Section 8 – Rights for Defects).
10. Liability
10.1 Saida Nails is liable without limitation for intent and gross negligence.
10.2 Liability for slight negligence towards entrepreneurs for breaches of essential contractual obligations is limited to the typical damage foreseeable at the time of concluding the contract and is otherwise excluded. Essential contractual obligations are the fundamental, elementary duties arising from the contractual relationship, the fulfillment of which is essential for the proper execution of the contract, whose violation jeopardizes the achievement of the contract’s purpose, and on whose observance the customer regularly relies and may rely. The aforementioned exclusions of liability do not apply to injury to life, body and health, nor to liability under the Product Liability Act and liability based on expressly given guarantees.
10.3 Saida Nails strives to keep the website www.saida-nails.de operational at all times. However, Saida Nails assumes no liability for damages and errors incurred by a customer in the event of temporary unavailability of the website.
11. Vouchers
11.1 Vouchers from and for the Saida Nails GmbH shop are valid for 1 year from the date of issue, unless explicitly declared otherwise. After this period, the corresponding voucher will be automatically deactivated and will lose its validity.
12. Privacy Policy
12.1 Saida Nails is entitled to store and process data received in connection with the business relationship concerning the customer, whether originating from the customer themselves or from third parties, in accordance with data protection law, insofar as they are necessary for the execution and processing of the order and the business relationship.
12.2 Furthermore, with regard to possible customer consents and further information on data collection, processing and use, reference is made to the privacy policy, which is available on the website www.saida-nails.de with the corresponding subpages of the website at any time via the “Privacy Policy” button in printable form.
13. Miscellaneous
13.1 Should individual provisions of these General Terms and Conditions and/or the contract supplemented by them be or become invalid, the validity of the other provisions shall not be affected. In the event of the invalidity of a single provision, the contracting parties shall endeavor to reach a new agreement, taking into account the mutual interests, which comes closest to the economic purpose of the invalid provision. The same applies to gaps in the contract that become known to the parties.
13.2 The business relationships between Saida Nails and the customers are subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.3 For all disputes arising from a contractual relationship, the court responsible for the registered office of Saida Nails shall be the exclusive place of jurisdiction, insofar as the customer is an entrepreneur or a legal entity under public law or a special fund under public law. This also applies to contracting parties without their own place of jurisdiction in the territory of the Federal Republic of Germany.
